This service allows any individual acting in a private capacity ("Client" or "You") to locate a mobile phone with the consent of the phone number owner whose location is being sought ("Service"). The purpose of these terms and conditions ("Terms and Conditions") is to explain how you, as a Client, can benefit from the Service. The Terms and Conditions may be updated periodically based on changes to the service; in this case, we will notify you by email at least one month in advance. Continued access and use of the Service after being informed of such changes, without canceling your subscription before the indicated month, will constitute acceptance of the updated Terms. 1. Initial Registration 1.1 Access and use of our Service are subject to creating an account on the Website ("Account"). 1.2 The following information will be required during registration: Email address Password As a Client, you guarantee the accuracy and truthfulness of the information provided and confirm that you are of legal age and authorized to subscribe to the Service in your country of residence. In case of identity theft, we reserve the right to take legal action. 1.3 The contract is not finalized until payment is confirmed. You can request a copy of your contract by email at any time. 1.4 The Account is strictly personal. After 24 hours, unless canceled, a monthly subscription of €47.90 will be activated and automatically renewed. 2.2 The prices include all applicable taxes. 2.3 Payment is made via credit card on our secure website. Right of Withdrawal 3.1 You have the right to withdraw from the contract within 2 days of receiving confirmation of the trial period. 3.2 To exercise the right of withdrawal, send an email with the request details. You will receive a confirmation email. 3.3 If the Service was not used after the trial period, the amounts paid will be refunded within 5-10 business days. If the Service was used, the withdrawal will be treated as a cancellation request effective at the end of the current month. 4. How the Service Works 4.1 After subscribing, simply enter the phone number you wish to locate ("Recipient"). An SMS will be sent with your request, which the recipient can accept or decline. We do not guarantee that the request will be accepted, and no refund is available if it is declined. 4.2 You may send an unlimited number of requests during the subscription period. 4.3 It is not permitted to: Use the Service for illegal or commercial purposes; Attempt unauthorized access to our systems; Spread viruses or use the Service for spamming. 5.Termination 5.1 You may cancel your subscription at any time by clicking "Unsubscribe." Termination will take effect at the end of the trial period or the current month. 5.2 Gruppo Media Srl may terminate the contract by notifying you via email in case of a breach of the terms. 6. Intellectual Property 6.1 Gruppo Media Srl owns all intellectual property rights related to our website and its content, including associated know-how. 6.2 By entering into this contract, we grant you a non-exclusive and non-transferable right to access and use our services. If you experience any issues, we offer the following refund terms: 7.1 Eligibility for Refunds: Refunds are available for unused services or in case of service interruptions due to technical failures. 7.2 Request Process: To request a refund, contact customer support within 14 days of purchase with your order details. 7.3 Non-refundable Services: Any partially used or fully consumed services are non-refundable. However, we shall not be held liable for interruptions caused by bugs, technical constraints, or other maintenance operations. Such interruptions do not entitle the user to any refunds. 8.3 The website may contain links to external sites that are not operated or controlled by Gruppo Media Srl, for which we cannot be held responsible for their functionality or content. 9. Miscellaneous 9.1 Force Majeure The parties agree that, in the event of the inability to perform the contract due to force majeure, neither party will be held liable for non-performance, delays, or failure to fulfill their obligations. The execution of the Contract will be suspended for the duration of the force majeure event. Payments for the current month will be retained. However, both parties retain the right to terminate the contract as outlined in Article 5. 9.2 Partial Invalidity If any clause in this contract is deemed invalid, the remaining provisions will remain valid. The invalid clause will be replaced with a provision that most closely reflects the intent of the original clause. 9.3 Communications All correspondence addressed to Gruppo Media Srl must be sent via email to: gruppomedia.smart@gmail.com or to the registered office: Gruppo Media Srl, Italy. 9.4 Applicable Law and Jurisdiction This contract and these Terms and Conditions are governed by the laws of Italy. Any disputes arising from these Terms and Conditions or the resulting contract will be submitted to the Court of Italy if Gruppo Media Srl is the claimant, or to the court of the Client’s residence if the Client is the claimant.
